1. Identification
This document establishes the Terms of Use for the game SurfTank, operated by Rede SurfTank, registered under CNPJ 50.000.273/0001-04, headquartered in Brazil.
By creating an account or using SurfTank, you acknowledge that you have read, understood, and fully agree to these Terms.
2. Definitions
- SurfTank: Online multiplayer electronic game, available for Windows, Mac, Android, and iOS.
- Coupons (CPs): Virtual currency acquired with real money or earned through gameplay, used in the in-game store.
- Gold: Virtual currency obtained exclusively through gameplay or by converting Coupons (CPs), used in game mechanics.
- Account: A personal and non-transferable record that grants access to SurfTank.
- Legal Guardian: A person aged 18 or older designated as the guardian of a user under 16 years of age.
- P2P Marketplace: An in-game system for trading items between players.
3. Age Rating
SurfTank has an age rating of 14+ (fourteen years or older), in accordance with the criteria set forth by Portaria MJ 1.048/2025 (Ministry of Justice Age Rating Ordinance) and the IARC system.
The game contains:
- Online challenges and competitions between players
- Virtual purchase system (restricted to users aged 18 and older)
- Player-to-player communication via chat and In-game Mail
4. Registration and Age Requirements
4.1 General requirements
To create an account on SurfTank, the user must:
- Be at least 14 years of age
- Provide a truthful date of birth (declared under the user's own responsibility)
- Provide a valid email address for account activation
- Accept these Terms of Use and the Privacy Policy
4.2 Users under 14 years of age
Registration of users under 14 years of age is not permitted, in accordance with the game's age rating.
4.3 Users aged 14 to 15
Users between 14 and 15 years of age are required to provide a Legal Guardian's email address during registration. The account will remain inactive until the Legal Guardian confirms the association through the link sent by email, pursuant to Art. 24 of Lei 15.211/2025 (Child and Adolescent Digital Protection Act).
4.4 Users aged 16 to 17
Users between 16 and 17 years of age may create an account without restrictions. Providing a Legal Guardian's email is optional but recommended.
4.5 Accuracy of information
The user is responsible for the accuracy of the information provided during registration. The date of birth is recorded with a timestamp and IP address for purposes of demonstrating procedural good faith. False information may result in Suspension or termination of the account.
4.6 Immutability of date of birth
Once provided, the date of birth cannot be changed by the user. If a correction is needed due to a typographical error, the user must open a support ticket and present documentation proving the correct date.
4.7 Account transfer (email change)
SurfTank allows changing the email address linked to an account, which enables the transfer of account ownership. When an email change is performed:
- The account is treated as if it belongs to a new person
- The new holder must provide their name and date of birth and accept the Terms of Use and Privacy Policy again
- The age verification (18+) is reset — the new holder must complete a new verification if they wish to make purchases
- If the new holder is under 14 years of age, the account will be locked
- If the new holder is between 14 and 15 years of age, Legal Guardian association will be required
- Previous purchase history remains linked to the account for auditing and tax documentation purposes; however, the personal data of the previous holder is disassociated
This measure ensures that age verification and consent always correspond to the current holder of the account, in compliance with Lei 15.211/2025 (Child and Adolescent Digital Protection Act) and the LGPD (Brazilian General Data Protection Law).
5. Purchases and Virtual Economy
5.1 Age restriction for purchases
The acquisition of Coupons (CPs) with real money is restricted to users aged 18 and older with verified age confirmation, in compliance with Lei 15.211/2025 (Child and Adolescent Digital Protection Act), which prohibits the real-money-to-random-rewards chain accessible to minors.
5.2 Age verification for purchases
Before making their first purchase, users aged 18 and older must complete an age verification process through the Didit service (didit.me), a platform specializing in digital identity verification. This service securely confirms the user's legal age without storing personal data beyond what is strictly necessary for the verification.
5.3 Nature of virtual goods
Coupons (CPs), Gold, and any virtual items:
- Have no real monetary value
- Cannot be converted into real money
- Exist solely within the context of the game
5.4 Player-to-player marketplace (P2P)
SurfTank features economic interaction systems between players:
- In-game Mail with charges: sending items between players for a payment in Coupons (CPs)
- Direct trade: exchanging items between players
- Auction: selling items at a fixed price or by bidding, with payment in Coupons (CPs)
- Guild: a system for sending Coupons (CPs) between members of the same Guild
Important: There is no direct transfer of Coupons (CPs) between players outside the Guild system. In all other systems, trades always involve items obtained through gameplay.
5.5 Restrictions for minors in the P2P Marketplace
In compliance with Lei 15.211/2025 (Child and Adolescent Digital Protection Act), accounts belonging to users under 18 years of age are subject to the following restrictions in the player-to-player marketplace:
- Sending and receiving Coupons (CPs) via Guild: blocked by default for users under 18, as Coupons (CPs) may originate from real-money purchases, constituting the chain prohibited by legislation
- Item trading, In-game Mail, and Auction: permitted, as these involve items obtained through gameplay with no link to real money
The Legal Guardian may manage additional P2P Marketplace permissions through the Guardian Dashboard.
5.6 Refund policy and immediate credit
By confirming a Coupons (CPs) purchase, the user acknowledges and expressly agrees that:
- The Coupons (CPs) will be credited immediately to their in-game account, constituting the full performance of the service at the time of payment confirmation;
- Once credited, the Coupons (CPs) may be used instantly in any game mechanic (store, Chests, Auction, P2P Marketplace), making reversal impossible without impacting the game's economy;
- Due to the nature of the digital product and the immediate performance of the service, with the consumer's express consent, the right of withdrawal provided under Art. 49 of the Codigo de Defesa do Consumidor (Brazilian Consumer Protection Code) does not apply, in accordance with established case law regarding digital content consumed immediately;
- If the user does not use the Coupons (CPs) within 7 (seven) days of purchase and requests cancellation, Rede SurfTank will review the request on a case-by-case basis and may issue a full refund provided it is confirmed that the credits were not used;
- In cases of undue charges, duplicate payments, or technical failures preventing the delivery of Coupons (CPs), a full refund will be issued regardless of the elapsed time.
Important: This condition is disclosed to and accepted by the user before each purchase is finalized. Express consent for immediate credit is recorded with the date, time, and IP address for evidentiary purposes.
5.5 Payment methods
Accepted payment methods include PIX, credit card (Stripe), MercadoPago, and PayPal, subject to availability.
6. Legal Guardian
6.1 Obligations
The Legal Guardian linked to the account of a user under 16 years of age:
- Confirms awareness that the minor uses SurfTank
- Has access to a web dashboard to monitor the minor's activity
- May view access history and account activities
- Receives periodic notifications about account activity
6.2 Guardian Dashboard
The Guardian Dashboard is accessible via a link sent by email and allows the guardian to:
- View basic account information of the minor
- Review activity and access history
- Monitor any transactions made on the account
7. User Conduct
7.1 Prohibited conduct
The user agrees to refrain from engaging in the following conduct, within or outside the game, on any communication channel (general chat, private P2P chat, In-game Mail, forums, linked social media):
7.1.1 Use of unauthorized software and game manipulation
- Using third-party software (hacks, cheats, bots, macros, auto-clickers, code injection) that alters the normal operation of the game or provides an unfair advantage
- Exploiting bugs, glitches, or system vulnerabilities for personal benefit or the benefit of others
- Reverse engineering, decompiling, deobfuscating, or performing any form of analysis on the game's source code
- Modifying, tampering with, or interfering with the game's files, data, or communications
- Using multiple accounts to gain unfair advantages, manipulate the P2P Marketplace, Auction, or in-game events
- Manipulating or falsifying transaction data, payments, or age verifications
7.1.2 Conduct against other players
- Insults and profanity: offensive, abusive, vulgar, or threatening language directed at other players
- Discrimination and prejudice: expressions of racism, homophobia, xenophobia, misogyny, ableism, or any form of discrimination based on race, color, ethnicity, religion, origin, gender, sexual orientation, age, or disability — conduct classified as a crime under Lei 7.716/1989 (Anti-Racism Law) and Art. 140 paragraph 3 of the Codigo Penal (Brazilian Penal Code) (Racial/Discriminatory Injury)
- Harassment and stalking: repetitive behavior involving intimidation, digital stalking, threats, or coercion of other players
- Defamation and slander: spreading false information about other players with the intent to harm them (Arts. 138, 139, and 140 of the Codigo Penal / Brazilian Penal Code)
- Disclosure of personal data: sharing one's own or others' personal data (real name, address, phone number, photos, documents) in game channels without consent (violation of the LGPD / Brazilian General Data Protection Law)
- Sexual or violent content: sending, sharing, or displaying pornographic, sexually explicit, gore, or extremely violent content, especially involving minors (crime under the ECA / Child and Adolescent Statute)
- Incitement: inciting violence, self-harm, suicide, illicit drug use, or criminal activities
7.1.3 Conduct against the system
- Creating fake accounts or accounts with fraudulent data
- Selling, buying, exchanging, or transferring game accounts for real money outside official channels (RMT — Real Money Trading)
- Attempting to access other players' accounts without authorization
- Carrying out attacks against the game's server or infrastructure (DDoS, flooding, etc.)
- Evading previous penalties by creating new accounts after a Ban
7.2 Penalties
Penalties are applied in a proportional and graduated manner, taking into account the severity, recurrence, and impact of the infraction:

Penalties are applied without entitlement to a refund of any amounts spent on the account. Rede SurfTank reserves the right, at its sole discretion, to impose more severe penalties in cases of extreme gravity, even on a first offense.
Referral to authorities: In cases that constitute a crime under Brazilian law (racism, racial injury, threats, sexual exploitation of minors, incitement to crime), Rede SurfTank may report the facts to the competent authorities (Federal Police, Public Prosecutor's Office), in accordance with the legal obligation set forth in Lei 14.852/2024 (Legal Framework for the Gaming Industry) and Lei 15.211/2025 (Child and Adolescent Digital Protection Act).
7.3 Chargebacks and payment disputes
A Chargeback (payment dispute filed with the card issuer, bank, or payment platform) without prior contact with Rede SurfTank support constitutes a serious violation of these Terms of Use.
By making a purchase, the user agrees that:
- In case of issues with a purchase (undue charge, non-receipt, duplicate charge), the user must first contact Rede SurfTank support through the ticket system
- Filing a Chargeback or dispute directly with the payment provider (PayPal, MercadoPago, bank, card issuer) without a prior attempt to resolve the matter with Rede SurfTank will result in:
- Permanent Ban of the account, or
- Suspension for a period proportional to the monetary loss caused and the time spent by the team to resolve the dispute, at the discretion of Rede SurfTank
- Ban or Suspension due to Chargeback applies regardless of the outcome of the dispute (even if the payment provider rules in favor of the buyer), as the violation consists of the failure to make prior contact, not the merits of the dispute
- Coupons (CPs) and items delivered to the player are recorded with a digital proof of delivery (SHA-256 integrity hash, timestamps, buyer association data), which will be used as evidence in contesting the dispute
Reversal: If the Chargeback is cancelled or reversed by the user with the payment provider, and Rede SurfTank confirms full receipt of the amount, the account may be reactivated upon review. The reactivation request must be submitted through the ticket system.
7.4 Appeal process
Users who receive Suspensions or Bans may contest the decision through the ticket system. The appeal process works as follows:
- Appeals are reviewed by the moderation team within 7 business days
- The user will be notified by email of the decision
- For temporary Suspensions, the restriction period remains in effect during the review
- A second appeal is possible if the user presents new evidence
- Bans for critical infractions (racism, content involving minors, fraud) are irrevocable
- Bans due to Chargeback are only reversible upon cancellation of the dispute and confirmation of payment
8. Intellectual Property
All content of SurfTank, including but not limited to graphics, sounds, text, source code, trademarks, and logos, is the exclusive property of Rede SurfTank or its licensors. The user is granted only a limited, non-exclusive, and revocable license for personal use of the game.
9. Data Protection
The processing of personal data is governed by our Privacy Policy, in compliance with the Lei Geral de Protecao de Dados (LGPD - Lei 13.709/2018, Brazilian General Data Protection Law) and Lei 15.211/2025 (Child and Adolescent Digital Protection Act).
Age verification data is used exclusively for that purpose, as required by law.
10. Account Security
The user is responsible for maintaining the confidentiality of their access credentials. Rede SurfTank:
- Uses SHA-512 encryption for password storage
- Implements suspicious login detection by IP and device
- Sends login notifications for unrecognized devices
- Will never request the user's password by email or chat
11. Service Availability
Rede SurfTank strives to keep SurfTank available but does not guarantee uninterrupted operation. Scheduled maintenance, updates, or force majeure events may cause temporary unavailability. Rede SurfTank is not liable for losses resulting from service unavailability.
12. Modification of Terms
Rede SurfTank reserves the right to modify these Terms at any time. Significant changes will be communicated by email or site notification with a minimum of 15 days' advance notice. Continued use of the service after such changes constitutes acceptance of the new terms.
13. Dispute Resolution
Any disputes shall preferably be resolved through mediation. If mediation is not possible, the courts of the jurisdiction where Rede SurfTank is headquartered shall have exclusive jurisdiction, to the exclusion of any other, regardless of privilege.
14. Reporting Channel
SurfTank provides a ticket system for reporting inappropriate conduct, improper content, or any violation of these Terms. The channel is accessible at Support / Tickets, as required by Lei 14.852/2024 (Legal Framework for the Gaming Industry).

These Terms are governed by Brazilian law, including:
- Lei 14.852/2024 (Legal Framework for the Electronic Gaming Industry)
- Lei 15.211/2025 (Child and Adolescent Digital Protection Act)
- Lei 13.709/2018 - LGPD (Brazilian General Data Protection Law)
- Lei 8.078/1990 - Codigo de Defesa do Consumidor (Brazilian Consumer Protection Code)
- Portaria MJ 1.048/2025 (Ministry of Justice Age Rating Ordinance)
